At Sue Ryder we have to follow the set rules and regulations and legislations set out by the Government and law, these are put in place to ensure that everyone in our care is protected. The Legislative framework for safeguarding is as follows:
NO SECRETS – Current Department of Health guidance on implementing and developing multi-agency policies and procedures so to protect vulnerable adults from abuse in England. In May 2011, The Government published a statement of Government Policy on adult safeguarding that sets out the principles for use by the Local Authority Social Services and housing, health and police and other agencies for and describing the development and assessment of the effectiveness of the local safeguarding arrangements, describing the outcomes and next steps.
SAFEGUARDING VULERABLE GROUPS ACT (2006) – Amended by PROTECTION OF FREEDOM (2012) Was put in place after the Soham murders, in which the Bichard enquiry recommended the development of service to stop unsuitable people from working with vulnerable adults or children, the Safeguarding Vulnerable Groups Act 2006 was passed and therefore as a result, The Independent Safeguarding Authority (ISA) was made. The act stated that employers must not knowingly employ someone who has been barred from working with vulnerable adults or children and must refer them to the Vetting and Barring Scheme, or Criminal Records Bureau (CRB). On the 1st December 2012 the CRB and the ISA merged to become The Disclosure and Barring Service (DBS), which we still use today.
MENTAL CAPACITY ACT (2005) – For people aged 16 years and over who live in a care setting that are unable to make certain decisions by themselves.
DEPRIVATION OF LIBERTY SAFEGUARDS (DOLS) – For those who are aged 18 years and over, that live in a care setting or that are long term stay in hospital and do not have capacity to decide on their care or liberty.
DIGNITY IN CARE – are improved standards in the way people in care are treated in a way that promotes Person Centred Care and Individuality.
HUMAN RIGHTS ACT (1998) – Allows us all to defend our rights in U.K courts and protects us, treating us all as equal and in a fair way with respect and dignity.
HEALTH and SAFETY at Work Act (1974) – This act covers other policies and procedures such as, Manual Handling and Infection Control.
THE CARE ACT (2014) – Clear legal framework on how local authorities should protect vulnerable adults.
