Social and health care study deals with so many title or issues what is consisting of confidentiality, food and hygiene, health and safety, personal care, legislations relating to health care, and so on. According to my assignment under the title of empowerment within the health care settings, under this title my effort will be focus on my capability and understanding of this assignment requirement. In general point of view, I just say about empowerment which is a very impressive concept to us and the entire health professional. So from basic sense, it can be defined as choices and preferences are prioritised because of the satisfaction of client and similarly it help to boost the worker confidence level whenever this power of preferences are used in successful way that means work independently and another way of thinking is that client preferences and choices are prioritise according to their demand of care services.
In order to provide best care service to service user, we as a care professional are working hard to carry out our task according to current guidelines, legislations which is very helpful to protect the whole care unit in both sides. Firstly, I can draw somewhat about the obstacles which are properly, guided by the legislations, laws, guidelines for the benefit of health care client and working professional. Let’s have a look at some of the legislation in below:
Suppose if we take the ACT of health and safety at work 1974, this law cover the most beneficial things for worker and its shareholder. It can be applied in the entire areas of working in care homes, hospital, General Physician Surgery, restaurant, etc. so basically this law protect the client health and safety as well as care staff safety too in health care homes. Under considering application the different laws in care field we can judge the whole picture of empowerment as all laws are functioning to keep active the care work legislation and different care premises are protected from any malpractices of drug using, unprofessional things.
Manual handling operations act 1992 is another government legislation which is required to follow in the home care and health practicing sites. This is about to use the different tools, equipment s for caring client or patients while we provide them health caring. It may include hoisting a individual in care premises. First of all, the carer must need to know the use of it. If he or she doesn’t have any idea of using this, they must to gain this skill through training or appropriate induction by the senior staff of the caring site. We can also see some other tools are used in relation to health care such as sling, sticks, urine bag, eating or feeding pipe, etc. are need to operate under this law of application.
Health act 1999 is reflecting power of care provider but it also simplify the service according to current legislation in where this law covers the group of service provider which is pooling the funds for the health charges.
Equality act 2010 is also ensuring the client as treating all is same.
Data protection act 1998 and GDPR short form of General data protection regulation which is in practice on 25th may2018 in care field. This law newly adapted to human right law by taking new steps.
So this way, we can see application different legislation, as an example I can mention of mental capacity act 2005 is another major legislation what can be very meaningful for client who cannot make any decision on their own. So this law are helping to overlook the client right for getting the right services when they require.
Care Act 201 is all about to support the fulfilment of the Act promises’. Mainly this act covers the detailed guidance on all aspect of professional field level part 1 is followed by local authorities, NHS, Police and other associated partner caring provider.
Some significant way of this act would be to guard or protect of the client from different barriers and addresses them to maximise their satisfaction. Furthermore, a real care effort enhances the standard of care and support client by following the codes of conduct in meaningful way. As because of happening this law become main guidance’s or rules to protect the individuals from depriving any kind of opportunity and rights. For the this issue we can see all above law, rules, legislation are making difference in real life to establish the vulnerable people right and wishes and even this laws help to enjoy their daily life as same as normal citizens does.
Legislation about medication which called Medication administering act 1988 is helpful for providing drug uses in care homes and client home. Moreover this is the guidelines for carer who gives medicine to client from blister pack. Same rules applies to pharmacist, doctor, nurse, etc who are directly involved in caring sector.
The above mentioned laws are empowering us and even health care client at point of order. So it easy to say that acts are formulating to the people in empowerment condition and health based client are also prioritise their choices as well.
How they are considered to be empowers. These conditions are discussed below:-
Consider of permission to empower is depends on how relationship is between care professional and health care patient. Without showing respect to client views, beliefs system, traditional values, wishes, etc is cared for to furnish their choices. As we know that condition about caring the client is no assumption acceptable. So according to equality Act we the carer are in point of main order of service providing to our client on multi-diversified way of respecting to client as equal right of faith, practicing religion, etc.
So this way all legislations and laws are helping the client and care work professional in positive way to provide the best service as possible.
Communication trend of health care service: which is aiming to reach our target through a designed model of channel, and which can achieve of practising our skills and professionalism values. It is happening now and then around us that communication is a way of contact with so many compositions of signs, gestures, expression, etc. Let say we send text through phone, email, or using modern device help, we use email. Some of us we use post office services to send letter, mobile apps like messenger, what’s app, face-time. Etc. some time it is happening in formal way and sometime it is happen in informal way and so on. Basically it is a way of contact to get our wishes is done. Little bit more about communication, we can see there are lot of options are picked up by the care provider in terms of caring services is given to client for well-being and health improvement. Now days we can also see the massive use of interpreter service in this sector, especially in NHS, Court, police department, immigration department. Therefore communication is taken into account for the health care services now with a view to better understanding of the patients need and thereby we provide the health service to recover any bad health situation by applying the communication model. From this statement of communication trend can show us it s effectiveness of caring individual health in better way. So for this purpose, we can find the care organisation have the designated communication channel which are dealing with customers/client satisfaction by taking their feedback as it is defined some specific people are working to follow up client complain. Looking at one stage of performances that we all are agree a proper communication can help the both side to get clear understanding of service, comfortable of care given to health client as it is done by participative discussion.
In what ways make the client more dependent, there are so many policies and legislations are practice in the similar field which are directly supported by government and its partner authority. Those legislations mostly help the client to protect from any sort of harming or hazard in relevant field, this trend also help to develop the human rights and other human aspect of improving their health condition providing the proper care and services in point of contemporary legislatives and guidelines. If we look at the United Kingdom context of Human rights law application it is guided and follows anything according to European similarity laws of application and this law is there to save them from discrimination, racism, or any other cultural differentiations. As an example I can present something from the care homes venues inhere a client or patient have their own right to choose and denied/reject any specific service from the support worker, nurse or doctor in any care venues just because of the fundamental right under human right law.
Mr Hasmat 27 who is taking care service in care homes for his mental disorder and some other health problem .i.e. dementia, diabetic, blood pressure, etc. makes him bound to stay there and semi-kind of disability attached to him. But my highlighting mark is to evaluate his beliefs; traditional practices what he has already inherited from his ancestor and performing on occasionally or non occasion basis. In one occasion he claim that he cannot eat anything from care home authority because he need to eat something special on particular day of celebration such Pilaw (sweet and coloured) rice with sweet korma which is only cooking at his home and served on a table among the different guest who came to gather for celebrating the special day like EID (something similar to Christian people celebrating on Christmas day). For the celebration of any special day a Muslim people always follow their tradition and current practices according to their religion. So from this point of view, anywhere, any care centre, any health service centre must evaluate his/ her beliefs, traditions, ethnical ground are needed to be cared and treated as an unique basis. This is indicating on valuing them according to existing legislatives practices such equality act 2010. We cannot agree on that point only but there is some other thing what is need to consider about the client social, physical, sexual chances may happen in care homes. From above discussed point we easily can feel that legislation and other policies are there to protect their right to get quality health care services in every where possible.
The vulnerable group of people in the society are in danger to get harm or abuse in real situation comparing to normal people as to why they are powerless or very little capability they have to protect or save from any abuse or harming. From that sense, it enhances the power of understanding among the care or support worker how to address this issue and solve the problem essentially to guard the old people right, choices, abuse in physical, mental and sexual ground. In here we can see various level of effort are undertaking by the care provider organisation. They take step to address by staff level are correct to deliver their service to old people as they are suffering a lot due to aged bound disease. This point lead us to consider the implemented way, guidelines, procedures and different legislative path by insisting on professional level, skills, experiences which can solve any unfavourable side of caring issue within this setting of caring field.
We see majority of individual in care homes are old aged people who is been sufferings from various health problem. Let say for example dementia, heart disease, diabetic and also who cannot live without any care support as their life depends on other support worker they must need to qualify for this job. Otherwise this group of people may have some negative health problem in everyday living. So the support staff, health care staff, doctor or nurse needs to have skill or detailed knowledge about discrimination, race, colour, gender issue and different ethnic values and norms.
After above all discussion points, it make me help to conclude a generic comment about empowerment which must empower the service user in so many ways; such as evaluate their beliefs, showing respect their cultural and respect to any other ethnical values, norms and traditional behaviour what can help to feel them they are not isolated and mostly feel comfort and relax in their way of life cycles. In the context of care home venues it also show us the organisational policies and procedures must have to respect their client views, preference and choices what can make them empower and similarly the way the support staff need to have their own skills and sufficient knowledge to serve their health services to the client in best way possible what could also make them feel happy and more empower to carry out their in successive way.
